Name, Image, and Likeness (NIL)

Name Image and Likeness (or NIL) were approved for North Carolina high school athletes by a Wake County Superior Judge on October 11th. As this is new to us, I'd like provide some information for those that may have been contacted about an NIL agreement. Before a student-athlete enters into ANY NIL agreement, they must first follow the NIL policy set forth by the State Board of Education.

This policy states:

  • A copy of each proposed agreement MUST BE submitted to the school Principal, Athletic Director, Superintendent, and School Board Chairperson BEFORE signing the agreement.For each NIL agreement, a verification form is required.

  • A certificate of completion of the NIL education component—the NFHS NIL Course—MUST BE submitted to you, the member school, PRIOR to signing each agreement. The NFHS NIL Course Certificate of completion is a one-time requirement, but the certificate of completion should accompany each Verification Form submitted to the NCHSAA.

  • Once an NIL Agreement is signed, the member school MUST submit each Agreement and the Certificate of NFHS NIL Course Completion to the NCHSAA.

Please make sure that before you enter into any such agreements, you complete the requirements above and ask questions! Entering in an NIL agreement without following the proper paperwork/approval can deem the student athlete ineligible, and possibly jeopardize potential college recruitment.
